Terms of service

The terms on which we provide the assistant, what it costs, and how either of us can end it.

Last updated September 3, 2026.

Who you are contracting with

Overmountain AI is a trading name of Mountain Strategy LLC, a company registered in North Carolina, United States. In these terms “we” and “us” mean that company, and “you” means the business buying the service.

A signed proposal or order form, where one exists, sits above these terms wherever the two disagree.

What we provide

A chat assistant installed on your website. We read your site, build the assistant's knowledge from it, write the answers it does not cover, and give you a single line of HTML to install. Each month we read the questions your visitors asked, write answers for the ones it could not handle, and re-read your site so the answers stay current.

Enquiries the assistant captures are emailed to the address you give us, with the conversation attached.

Fees

  • $500 once, to set the assistant up.
  • $300 per month thereafter, billed monthly in arrears rather than paid up front.
  • A minimum term of 6 months from go-live, after which the service continues month to month.

Fees exclude any applicable sales tax. We may change our prices for future terms on thirty days' written notice; a change never applies within a minimum term you have already started.

Spending limits

Every account has a monthly ceiling on the cost of generating answers. When an account reaches its ceiling the assistant stops generating replies and offers your contact details instead, so the service degrades into a message rather than into a bill. We will tell you when this happens and you can raise the ceiling.

What the assistant will and will not do

The assistant answers from the material we index — your website and the answers written with you — and is built to decline rather than guess. It states that it is an assistant at the start of every conversation, and a visitor can ask for a person at any point.

It is still a language model. It can be wrong, it can misread a page, and it can phrase something in a way you would not have. You should not rely on it to state prices, availability, legal or safety information unless you have checked that the underlying material is right, and nothing it says forms a binding offer or a quotation on your behalf. Tell us about a wrong answer and fixing it is the work you are already paying for.

Your side of it

  • You are responsible for the accuracy of the material on your own website, which is what the assistant answers from.
  • You confirm you have the right to let us read and index that material, and to install the widget on the site.
  • You will keep your own privacy notice accurate about the assistant, including that conversations are recorded. We will help you word it.
  • You will not use the service to handle payment card details, health records, or other sensitive categories of personal information.

Data

You own your content and the enquiries the assistant captures. We process visitor data on your behalf as described in our privacy notice, which forms part of these terms. We do not sell that data and we do not use your conversations to train AI models. On request, or when the service ends, we will export everything held for you and delete it.

Availability

We aim to keep the assistant available at all times and we do not promise a specific uptime figure. The service depends on providers we do not control, and when one of them fails the assistant can stop answering. Your website is unaffected: the widget is a single script that fails quietly rather than taking a page down with it.

Ending it

After the minimum term, either of us may end the service with thirty days' written notice, effective at the end of a billing month. We may suspend the service immediately if fees go unpaid for thirty days, or if the service is being used unlawfully. On termination we remove the assistant, send you an export of your data, and delete our copy.

Setup fees are not refundable once the work has been done.

Liability

Nothing here limits liability that cannot lawfully be limited. Subject to that, neither of us is liable to the other for lost profits, lost business, or indirect or consequential loss, and our total liability arising out of the service is limited to the fees you paid us in the twelve months before the claim.

The service is provided as it is. We make no warranty that the assistant's answers will be accurate, complete, or fit for a particular purpose, which is why the section above asks you to check anything that matters.

Governing law

These terms are governed by the laws of the State of North Carolina, and the courts of that state have exclusive jurisdiction over any dispute.

Changes and contact

We may update these terms; material changes take effect thirty days after we tell you, and never inside a minimum term you have already started. Questions go to the contact form on this site.
